1. Acceptance of Terms

By accessing and using Quitchi ("the Application"), you agree to be legally bound by these Terms and Conditions. If you do not agree with these terms, do not use the Application.

2. Service Description

Quitchi is a mobile application (iOS and Android) with a complementary web version, designed to help people quit smoking through progress tracking, motivation, and support resources. The application includes: virtual pet Quitchi that grows with your progress, detailed health and money saved statistics, self-care, motivation and relaxation activities, personalized daily reflections, guided breathing exercises, relaxation games (Memory and Armonía), pot and seeds system, Greenhouse community to share experiences. The application offers free features with usage limits and unlimited premium features available through subscription.

3. Use of the Application

You agree to:

  • Provide accurate and up-to-date information
  • Maintain the confidentiality of your account
  • Not use the Application for illegal purposes
  • Not attempt to access restricted areas of the Application

4. Intellectual Property

All intellectual property rights related to Quitchi are the exclusive property of its creators. Reproduction, distribution, or modification without prior written authorization is not permitted.

5. Limitation of Liability

Quitchi is provided "as is" without warranties of any kind. We are not responsible for any direct, indirect, incidental, or consequential damages arising from the use of the Application.

6. Cancellation and Termination

Cancellation by user:

You can cancel your account at any time through:

Effects of cancellation:

  • All your progress and profile data will be permanently deleted
  • Access to your account will be deactivated immediately after confirmation
  • Data will be completely deleted from our servers within 30 days
  • This action is irreversible and you will not be able to recover your data

Termination by us:

We reserve the right to suspend or cancel your access to the Application if:

  • You violate these Terms and Conditions
  • You engage in fraudulent or illegal activities
  • You abuse the service or attempt to compromise it
  • Required by law or a competent authority

7. Modifications

We reserve the right to modify these terms at any time. Changes will be effective immediately after their publication in the Application.

We will notify you of any significant changes through:

  • A prominent notice in the application
  • Email to your registered address

Continued use of the Application after changes constitutes your acceptance of the updated terms.

8. Jurisdiction and Governing Law

The applicable law and competent jurisdiction will depend on your place of residence:

🇪🇺 Spain and European Union

For users residing in Spain or the European Union, these Terms are governed by the laws of Spain. Disputes will be submitted to Spanish courts and tribunals. If you are a consumer in the EU, you also have rights under the consumer protection law of your country of residence.

🇺🇸 United States

For users residing in the United States, these Terms are governed by the laws of Spain, with the following additional provisions:

Binding Arbitration: Any dispute arising out of or relating to these Terms or the Application shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA), rather than in court. You waive your right to a jury trial.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms to contact@quitchi.com

Exceptions:

  • Small claims court matters may proceed in court
  • Intellectual property disputes may be brought in court

🇨🇦 Canada

For users residing in Canada, these Terms are interpreted in accordance with the laws of your province of residence, while respecting your rights as a consumer under local legislation.

Cooling-off Period: Depending on your province, you may have the right to cancel within 7-10 days after purchase (if applicable).

🇦🇺 Australia

For users residing in Australia, these Terms are interpreted in accordance with Australian Consumer Law. Your rights as a consumer are protected under the Australian Consumer Law (ACL).

Consumer Guarantees: Australian Consumer Law provides legal guarantees that cannot be excluded, including guarantees of acceptable quality, fitness for purpose, and compliance with description.

Cooling-off Period: You may have the right to cancel within 14 days under certain circumstances, as provided by Australian Consumer Law.

🌎 Latin America

For users residing in Latin American countries, these Terms will be interpreted in accordance with the laws of your country of residence. Disputes will be submitted to the competent courts of your country, always respecting your rights as a consumer under local legislation.

🌍 Other countries

For users from other countries, these Terms are governed by the laws of Spain, but always respecting the minimum rights granted to you by the consumer protection legislation of your country of residence.

9. Dispute Resolution

If you have any dispute or complaint about the Application, we encourage you to contact us first to try to resolve the issue amicably.

Resolution procedure:

  1. Send an email detailing your complaint to contact@quitchi.com
  2. We will respond within 5 business days
  3. We will try to resolve the dispute amicably within 30 days

If we do not reach a satisfactory resolution, you may resort to the competent courts as set forth in the previous section.

11. Premium Subscriptions

Quitchi offers a premium subscription that unlocks additional application features for a complete, unlimited experience.

Premium service description:

The premium subscription gives you unlimited access to key features: unlimited guided breathing exercises (free version: once per day), unlimited personalized wish list with visual progress tracking (free version: limited), unlimited reasons to quit smoking with reminders (free version: limited), unlimited Memory and Armonía relaxation games (free version: once per day per game), full access to Greenhouse history (questions, answers and community), priority features and early access to new features.

Subscription types:

We offer monthly and annual subscriptions. Prices are clearly displayed before purchase and may vary by geographic location and platform (App Store or Google Play). The annual subscription generally offers a significant discount compared to the monthly one.

Automatic renewal:

Subscriptions automatically renew at the end of each billing period (monthly or annual) unless you cancel before the end of the current period. The charge will be automatically applied to the payment method associated with your App Store or Google Play account. You will receive a notification before each renewal.

Access to premium features:

While your subscription is active, you will have full access to all premium features without usage limits. If you cancel your subscription, you will keep access to premium features until the end of the billing period you have already paid for. After that, your account will revert to the free version limitations, but you will retain all your data and progress.

Price changes:

We reserve the right to modify subscription prices. If we increase the price of your existing subscription, we will notify you at least 30 days in advance. The new price will apply at your next renewal. If you do not agree with the new price, you may cancel your subscription before the change takes effect.

Trial periods:

We may occasionally offer free Premium trial periods. If a trial period is offered, you will be clearly notified before subscribing, including when the trial will end and when charging will begin. At the end of the trial period, your subscription will automatically renew unless you cancel before the end of the trial period. You may cancel during the trial at no charge.

12. Subscription Cancellation

You may cancel your premium subscription at any time. Cancellation will affect future renewals, but not your current access.

How to cancel:

  • Apple App Store: Cancel your subscription through your Apple ID account settings (Settings → [Your name] → Subscriptions). Cancellation will take effect at the end of the current billing period. You will keep access to premium features until the end of the period you have already paid for.
  • Google Play Store: Cancel your subscription through Google Play Store settings (Play Store → Menu → Subscriptions). Cancellation will take effect at the end of the current billing period. You will keep access to premium features until the end of the period you have already paid for.

Effects of cancellation:

  • Your subscription will not automatically renew at the end of the current period
  • You will keep access to all premium features until the end of the billing period you have already paid for
  • After your subscription expires, you will lose access to premium features and return to the free version of the application
  • Your progress and profile data will remain intact

Refund policy:

We do not handle subscription refunds directly. Refunds must be requested through Apple (App Store) or Google (Play Store) as applicable. Refund policies are subject to each platform's terms and conditions.

In general: If you cancel during a trial period, you will not be charged. If you cancel after a renewal, you will not receive a refund for the remaining period, but you will keep access until the end of the paid period. For refund requests, contact Apple or Google support.

Cancellation during trial period:

If you cancel during a free trial period, you will not be charged anything and will lose access to premium features immediately upon cancellation. You may cancel at any time during the trial period at no cost.
